Your Wedding or Event contract , once signed, and deposit paid, will reserve coverage for your event/wedding. Payment information is at the bottom of this page. Remaining balance is due 10 days prior to Event Date, failure to comply with payment schedule may lead to forfeit of event/wedding day coverage. Payment of remaining balance can be made in small payments or all at once, final payment will guarantee coverage and timely delivery of your videos/photos. Terms are outlined below.
TERMS:
364 Productions is hereby the videographer/photographer hired for the event , dated above. Agreed on advance by client and videographer/photographer, 364 Productions will send a suitable and competent videographer/photographer to capture video footage of said event for editing purposes. Editing is to be performed solely by 364 Productions editors.
SINGLE SHOOTER CLAUSE:
If a single shooter is booked rather than multi shooter packages, any hereafter mention of additional camera persons, assistants, or second shooter, is exempt from contract. Client may add coverage of a second shooter, up to 30 days prior to the wedding, after 30 days prior to wedding, pricing may be subject to change. Client accepts final edited footage "as is" and without penalty to the videographer/photographer or single shooter. Videographer/photographer will make every attempt to obtain quality and acceptable footage/images in the client's best interests in accordance with their wishes and requests made in advance through a questionnaire.
PRE-PRODUCTION:
Videographer/photographer will provide a pre production questionnaire approximately 30 days prior to wedding date and is to be completed by the client 14 days prior to wedding/event date. Client will provide videographers/photographers with written "special" instructions for filming/photographing ceremony and any other planned events to be featured in film, where special requirements must be met, (i.e. if church or venue has off limits spaces). Questionnaire will serve as a logistical and organizational function to aid in video production.
PRODUCTION:
Includes: Wedding Day /Event Video Coverage. Up to ten hours of video coverage from arrival to the first location at the designated start time. This time includes any travel beyond the first location to be filmed. Any breaks, lunches, dinners, or scheduled down time are also included in this coverage timespan. Any delay in scheduled events ; beyond the scheduled 10 hours of initial coverage may result in overtime ; being billed at the rate of $100 per hour, rounded up to the nearest hour. Videographer/photographer will obtain client’s verbal permission before any overtime coverage has begun. Videographer/photographer may be dismissed before ten hours if client is satisfied with coverage or wishes for remaining events to no longer be filmed. Client must designate a safe area for videographer/photographer to stand to obtain a clear view of bridal party , groom, and bride during precessional of wedding ceremony. It is recommended to have your videographer/photographer stand in the aisle with a monopod to get a clear view of the precessional and your second videographer/photographer positioned off to the side of the first row of guests. Unless otherwise requested , Videographer/photographer will film precessional from the center aisle , while the assistant will film the groom’s reaction. Videographer/photographer will then continuously film the ceremony from the sides if physical space allows. Client must plan ahead and notify in writing via questionnaire when videographer/photographer should arrive back to the aisle for a clear shot of the kiss and exit. With designated areas to film safely from, videographer/photographer will make every effort to film with a clear view, but can not be held responsible if our view is blocked by other photographers, other vendors or officiants, cameras, decorations, wedding guests, bridal party, or any other visual obstruction. Any scheduled events MUST be documented in the questionnaire, failure to due so may result in omission from the final film. Unless otherwise requested, events to be included in the final film are as follows: Bride and groom preparations, Ceremony Vows, (a separate video will feature the full length ceremony, up to thirty minutes in length, Reception events, and any scheduled event documented in clients questionnaire. (ceremony lengths beyond 40 minutes cannot be guaranteed as cameras have a 30 min run time) Any B Roll, ambience footage, candid footage of guests are considered auxiliary and not mandatory to be in final film.
FOOD / BREAKS:
Since our videographer/photographer will be with the bridal party all day it will be necessary for at least 2 scheduled breaks, the first will be taken during the day, and the 2nd during the reception. Every effort will be made by our staff to take breaks during "down time" segments of the event. If a meal is served during the reception we ask that you provide our videographer/photographer with a meal that will be taken after all other guest, if no meal is supplied we ask that a 30 minute break be given for the videographer/photographer to eat. Most catering services will provide you with a discounted meal or simply not charge for your videographer, photographer, DJ, etc.
CAMERA SHY CLAUSE: Videographer/photographer will make effort to film auxiliary footage of client’s family and guests, but can not be held responsible for any lack of footage from any particular guests, groups of people, decor, or locations. Some people are uncomfortable on camera and may avoid being filmed. If there is any particular persons, heirlooms, decor, or any other subject to be filmed, client must make note in the questionnaire. Subjects/ persons noted in questionnaire will be featured a minimum of three seconds in final film. Every reasonable effort will be made to take requested footage, but no specific auxiliary footage can be promised. Any lists supplied will be used for organizational purposes only.
POST-PRODUCTION:
Editing of footage will include: Music curated and licensed by the videographer to be included in a highlight “trailer” film with a minimum run times agreed upon in quote. A wedding “film” running a minimum of agreed length in quote. Wedding film or “final film” will include designated events dictated by client’s questionnaire at videographers discretion. Footage determined by the videographer to be substandard or duplicate may be edited out. The Videographer will use their professional judgment and sole discretion to select which footage to deliver. Such selection shall constitute all footage that will be made available to Client. Videographer does not guarantee client or any other persons “Raw” footage or any unedited work.
DELIVERY:
Delivery will be made by videographer/photographer digitally with an online download address. Client may not sell, or distribute video or footage for monetary gain. Client may share videos with friends and family for personal use or on any social media outlets (tagging of 364 productions social media is appreciated but not required). Client may download and archive videos for personal use. Uploading of videos for personal use to sites such as youtube or vimeo is allowed with credit to 364 Productions (Music rights will need to be obtained from 364 Productions if flagged). Client may “burn” DVD discs or any other digital back up medium without penalty. Any client requests for revision are at videographers sole discretion.
Agreement/Jurisdiction:
The person(s) whose signature(s) appear on this contract, known as "Client", agree that 364 Productions, known as "Videographer/Photographer", shall provide services to film their wedding/event and related events to the best of their abilities, in the manner described in this document. This is a binding contract which incorporates the entire understanding of the parties, and any modifications must be in writing, signed by both parties, and physically attached to the original agreement. The laws of the State of Tennessee shall govern this contract, and any resulting arbitration shall take place within Davidson County, Tennessee. Client assumes responsibility for all collection costs and legal fees incurred by Videographer/photographer, should enforcement of this contract become necessary. In the event that any part of this Agreement is found to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. Any failure by one or both parties to enforce a provision of this Agreement shall not constitute a waiver of any other portion or provision of this agreement.
Payment:
A non refundable deposit in the amount of $500 and a signed contract must be received in order to reserve wedding/event date. The balance due for the videography/photography services must be paid in full no less than 10 days before the event date. In the event Client fails to remit payment as specified, the videographer/photographer shall have the right to immediately terminate this Agreement with no further obligation, retain any monies already paid, and not attend this event. Returned checks will be assessed a $50 non-sufficient funds fee, and all future purchases/payments must be paid by Cashiers Check. Unless the contract is canceled, the deposit shall be applied to the videography/photography fee total.
Cancellation:
If for any reason Client cancels this contract before the wedding date, Videographer/photographer shall keep the deposit. Cancellation must be made in writing, signed by the contracted party, and sent via Certified Mail by the United States Post Office. If Client fails to supply written cancellation as specified before the wedding date or cancels within 30 days of the wedding date, Client shall be required to pay the full balance due.
Reschedule:
In the event that Client reschedules the wedding/event and videographer/photographer is able to rebook the original wedding date, Client will receive credit for all monies already paid. A new contract may be required. The new package price will reflect pricing in effect when the date change occurs. In the event that Client reschedules the wedding/event and videographer/photographer is not able to rebook the original wedding date, Client forfeits the deposit but will receive a credit for all other monies paid. Credit may be applied to wedding coverage within one year of original date provided videographer/photographer is available.
Liability:
If Videographer/photographer or their agent is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, transportation problems, acts of God, accident, illness, or technical problems, and if they cannot provide another competent professional, all money received by Videographer/photographer, minus expenses, will be returned to Client, and Videographer/photographer shall have no further liability with respect to this agreement. This limitation of liability also applies to any loss/damage of videos or failure to deliver videos for any reason. Liability for a partial loss of videos shall be pro-rated based on the percentage of total. The sole remedy for any actions or claims shall be limited to a refund whose total amount cannot exceed the total monies paid by Client under this Agreement during the time preceding the date on which such liability arises.
Video Archiving:
Upon receipt of a video/photos, Client accepts all responsibility for archiving and protecting the videos/photos. Videographer/photographer does not permanently archive image files. Videographer/photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read video/photos provided. It is Client's responsibility to make sure that digital files are archived and copied to new media as required.

Services or merchandise not included in this initial contract will be sold at current price when an order is placed. All prices not outlined in this contract are subject to change at any time without notice.
Responsibilities:
Unless agreed upon in advance, 364 Productions shall be the exclusive videographer/photographer retained for the event. Videographer/photographer may bring one assistant at their discretion. Photographers and other vendors as well as amateur videographers/photographer must not obstruct or interfere with the official videography/photography. Wedding guests may take videos, but it is the responsibility of Client to prevent family and friends from interfering with Videographer/photographer's duties. Videographer/photographer is not responsible for compromised coverage due to causes beyond their control such as other people's camera or flash, the lateness of the bride, groom, family members and bridal party members or other principles, weather conditions, schedule complications, rendering of decorations, or restrictions of the venues or officiate. Videographer/photographer is not responsible for existing backgrounds or lighting conditions which may negatively impact or restrict the videography/photography coverage. Client agrees to confirm the schedule one-week prior to the event and to send the Videographer/photographer a copy of the invitation prior to the wedding. Notification of any changes in schedule or location must be made in a timely manner. Changes can be made by phone with a follow-up email for documentation. If email is sent, confirmation of receipt must be obtained.
Harassment:
Ensuring the appropriate behavior of all guests and other persons at the wedding and other events covered by Videographer/photographer shall be the responsibility of Client. In the event Videographer/photographer or their employee experiences any inappropriate, threatening, hostile or offensive behavior from any guest or other person at the wedding or other event (including, but not limited to, unwelcome sexual advances and verbal or physical conduct of a sexual nature) then the following process shall be followed: first offense: a verbal warning will be issued to a family member of the client; second offense: the offending person will be required to leave the wedding or event; third offense: Videographer/photographer will end wedding/event coverage immediately and leave the event. Videographer/photographer shall be entitled to retain all monies paid here under and client agrees to relieve and hold Videographer/photographer harmless as a result of incomplete wedding or event videography/photography coverage.
Model Release:
This contract serves as a model release giving the Videographer/photographer the irrevocable right to use the videos/photos in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. The Videographer/photographer can grant use of the images to third parties and all compensation for use and credit for the images remain the property of 364 Productions. This release is binding on the Client, their legal representatives, heirs, and assigns.
